Data Search Terms and Conditions

If permission to access the data held by RECORD is granted I/We understand the following:

By agreeing to these terms and conditions (on acceptance of the quote provided by RECORD), users agree to pay the associated fee, and payment terms, for the data provided. In the event of a search enquiry being cancelled, RECORD reserves the right to charge for any work already undertaken.
RECORD reserves the right to refuse to provide data services where provision of those services may result in an increased likelihood of damage to the natural environment.
I/We agree that data retrieved from RECORD will not be passed on to or communicated with third parties except as aggregated data within reports, or as anonymised data in the form of maps etc., which constitute a part of the agreed reason for the original enquiry. To this end, I/we agree not to share the raw data as part of any report that will eventually be published on the planning portal. (Inclusion of this data in a clearly marked confidential appendix is acceptable)
RECORD must be acknowledged within any report, or other product produced, using data provided by RECORD. The Cheshire Local Wildlife Sites Partnership must be acknowledged within any report, or other product produced, using Local Wildlife Sites (LWS) data provided by RECORD.
I/We agree that data released, to us, by RECORD will not be added to any permanent database system (electronic or paper based) unless by written agreement with RECORD. This form of agreement will incur further charges related to length and potential multiplicity of use.
RECORD tries its utmost to ensure the accuracy of its records. However, it is impossible to guarantee the veracity of every single species observation, and we therefore disclaim responsibility for the accuracy of information supplied. Individual records can be queried with the RECORD office if necessary.
LWS data is accurate at the time of supply. Following periodic meetings of the LWS Partnership, LWS data are reviewed and updated accordingly. While every effort has been made to verify LWS information, the boundaries of sites should be considered as indicative and not definitive.
I/We agree to inform the Cheshire LWS Partnership when there is a possibility of direct or indirect detrimental impacts on the features for which a LWS was designated (this includes land use and/or management changes within or adjacent to a LWS boundary). A consultation should be made with the LWS Partnership to avoid, reduce, or mitigate those impacts.
The request for LWS data cannot be stated to be a consultation with the Cheshire Local Wildlife Sites Partnership on a particular development.
I/We agree not to use, or pass on, any data provided by RECORD (See note 3 above) in an unethical or irresponsible manner, especially where doing so may result in damage to the natural environment.
RECORD shares anonymised search details with colleagues in Cheshire Wildlife Trust to support nature conservation. Please contact RECORD in writing before accepting the quote if you do not want this information to be shared.
It is the user's responsibility to ensure that the laws of copyright are not breached.
Non-adherence to these terms and conditions will be viewed as a breach of contract which may result in legal redress being sought.
